When someone passes, his/her relatives must check if there is a will. If they cannot find the will, they can either check at the Wills Registry or ask the testator’s lawyer.
Is there a Wills Registry in Cyprus?
In Cyprus there is a register of Wills in every County Court, where the original document of the Will can be deposited. The Wills Registry is kept by the Registrar of each County Court. However, the filling of the Will into the Courts’ Registry is not obligatory for the testator.
What happens if the Will was not deposited at the Wills Registry?
Whether or not the Will is deposited in the Wills Registry, this does not affect the validity of the Will. Usually, the person who is appointed as the executor of the Will, shall know where the Will is kept so it may be prudent to approach the executor. Most of the times, the lawyers are entrusted with the will, since its them who usually draft the will for the testator.
Who can file the Will at the Wills Registry?
In Cyprus the will is usually filled by the testator accompanied by his lawyer. However, either of them can file the Will alone.
How is the filing of the Will made?
The Registrar of the Court shall provide an envelope in which to insert the will. On the envelope a specific wording must be included; otherwise the will shall not be accepted from the Registrar. At the presence of the Registrar and the testator the envelope with the will is sealed with a wax seal and the Registrar is responsible for keeping safe the will.
How much does it cost to file a will at the Wills Registry?
The stamps for the Will Registry is around 20€.
Why shall I make a will?
A Will contains the last wish of the testator and is made to ensure that this last wish is honored upon death. Without a Will in Cyprus, one’s assets will be distributed according to the laws of succession. For example, if the deceased is survived by a spouse and three children, the property will be divided into four equal shares between them. So its very important to make and keep your Last Will in a safe place and appropriately stored. After making a will, in order to enforce it, the original Will must be located.
